Oerlikon & Himson Confirm Exclusive Patent Rights
Oerlikon and Himson have issued a joint notice confirming exclusive patent rights, reinforcing intellectual property protection and clarity for the textile machinery industry.

This is to inform the public at large that Oerlikon Textile GmbH & Co. KG., Leverkuser Strasse 65, 42897 Remscheid, Germany, including its subsidiaries, assignees and group companies, (hereinafter referred to as the “OERLIKON”) engaged in the field of aerospace, automotive, energy, medical, luxury, semiconductor, tooling and general industry and, is leading manufacturers for manmade fibre spinning systems and texturizing machines.

OERLIKON is the registered proprietor of Indian Patent No. 316763 titled “A False-Twist Texturing Machine For The Texturing Of A Plurality Of Multifilament Threads” (hereinafter referred to as the “said patented technology”) which is valid and subsisting Patent.

Further, Himson Engineering Private Limited having its office at Survey No. 352, Hiralal Colony, Ashwanikumar Road, Surat – 395008, Gujarat, India (hereinafter referred to as the “HIMSON”) is the flagship company of the Himson Bhogibhai Group and one of the largest manufacturers of textile machinery in India, with an experience of more than 5 decades and a strong global footprint.

HIMSON has been granted a sole license by OERLIKON to use, manufacture, market, and commercialize the said patented technology within the territory of India.

It is hereby notified that any person, firm, or entity using, manufacturing, selling, offering for sale, importing, or in any manner dealing with any product or process falling within the scope of the said patented technology, without due authorization, shall be deemed to be infringing the patent rights of the OERLIKON. Such unauthorized use constitutes infringement under the Patents Act, 1970, and the infringing parties shall be liable for all legal consequences, including injunctions, damages, and recovery of loss of profits.

The public is hereby cautioned not to engage in any activity that amounts to infringement of the said patent. OERLIKON and HIMSON, individually and/or jointly, reserve their rights to take appropriate legal action against any person, firm or entity found to be infringing or assisting in the infringement of the said patented technology.
